On 21 October 2008, the Office of Fair Trading announced that it has commenced an investigation into an illegal cartel by eight recruitment agencies active in recruitment for the construction industry. Each agency has been sent a Statement of Objections, which sets out details of the allegations against them during the period 2004-2006. The principal claims are that: (i) a collective agreement was in place under which the agencies agreed not to supply candidates to a particular intermediary company; and (ii) the agencies were engaged in fixing the target fee rates for providing candidates to intermediaries and specific construction companies. The agencies now have the opportunity to submit written and oral submissions in their defence.
