On 6 May 2010 the President signed Federal Law No 81-FZ amending the Criminal Code.
According to article 143 of the Criminal Code, failure to respect the labor safety rules may entail, in particular, criminal liability for the company's executives (if the violation of the labour safety rules has caused, as a result of negligence, serious harm to health):
- a penalty of up to RUB 200,000 (USD 6,667) or the amount of a salary or other income for up to 18 months,
- correction works for up to two months, or
- imprisonment for up to one year.
The Law provides for another type of penalty that may be imposed for violation of the labor safety rules – mandatory works for a term of up to 240 hours.
It is also noteworthy that the criminal sanctions may be more sever if the violation has caused human death. In this case the company's executive may be imprisonment for up to three years and deprived of the right to occupy certain positions or perform certain activities for up to three years.
The Law entered into force on 11 May 2010.
