The April 1, 2008 filing date for requesting H-1B work visas that would commence on October 1, 2009 (the first day of the fiscal year for the U.S. Citizenship and Immigration Service) is fast approaching. For employers seeking new H-1Bs for foreign workers to work in the United States, it is imperative that the H-1B petition be filed on April 1. Last year, the cap was reached on the first day, so filing a petition just one day late will mean that the employer will not have a chance to obtain a work visa under the H-1B cap. Practically speaking, the H-1B situation has become a lottery, and to be able to participate in that lottery, employers must get their H-1B petitions into the USCIS on the first day petitions may be filed.
