In March of 2011, Taiwan's Fair Trade Commission (“TFTC”) approved the merger filing of a Blu-ray DVD patent pool.  On January 23, 2013, TFTC further announced a conditional approval of a merger filing by LG Electronics, Pioneer, Philips and Sony for DVD patent pool.  Said four companies would jointly invest in and operate One-Red LLC to license certain essential DVD patents.  TFTC approved the merger filing on condition that the companies would refrain themselves from (i) entering agreements relating to the price or quantity of DVD; (ii) exchanging important transaction information; and (iii) limiting licensees’ use of the licensed technology, transacting parties, or product pricing, among other things.  The aforementioned conditions on the DVD patent pool are similar to those set forth in TFTC’s 2011 Blu-ray decision.
