On 14 May 2015, the "Guidelines on the matter of protection of the whistleblower", adopted by the National Anti-Corruption Authority ("A.N.A.C.") with Determination no. 6 of 28 April 2015, were published in the Official Gazette of the Italian Republic.
These Guidelines establish measures for the implementation of the provisions introduced by Law no. 190/2012 on the matter of prevention and sanctioning of corruption and illegality in public administration and provide information on the measures to be adopted by the public administrations in order to ensure the confidentiality of the identity of public servants who report illegal conducts. The purpose of the Guidelines is to encourage public servants to report illegal facts of which they become aware at work and, at the same time, to ensure their protection.
The Guidelines also provide important clarifications on the scope of the rules on whistleblowing, both from a subjective and an objective point of view, on the conditions which have to be met to receive protection under the same rules and on the role of the person responsible for the prevention of corruption within public administrations.
