Recent Development

The Regulation Amending the Regulation on Commercial Advertisement and Unfair Commercial Practices was published in the Official Gazette on December 28, 2018. A new article introduced to the Regulation on Commercial Advertisement and Unfair Commercial Practices ("Regulation") titled "The Advertisement of Foods to be Eaten in Moderation" restricts the advertisements of these products.

The introduced article, which limits the advertisement of the foods to be eaten in moderation, will enter into force on June 30, 2019.

What's New?

The introduced Article 24/A of the Regulation restricts the advertisements of certain foods and beverages in children's radio and television programs. Article 24/A prohibits radio and television programs or channels aimed at children from running advertisements at the beginning, during or at the end of the shows of any foods and beverages that fall under the Ministry of Health's "red category," which are foods and beverages the Ministry of Health recommends be consumed limitedly.

As per the same article, advertisements shown in radio and television programs not aimed at children should contain written or verbal warnings encouraging a proper and balanced diet as a clearly visible banner. In other mediums of advertisement, the written or verbal warnings should be introduced in a suitable and similar manner to that medium.

Additionally, the introduced article prohibits promotions and similar marketing tools aimed at children to increase the sale of foods to be eaten in moderation.


According to this regulation, the advertisers should monitor the "red category" of Ministry of Health which consist of the foods and beverages to be consumed in moderation and should take not and comply with these limits and prohibitions as well as the prohibition of the promotions aimed at children to increase the sales of these products starting on June 30, 2019.
