A House of Commons select committee (the Business and Enterprise Committee) has published a report into the supply ties operated by pub companies. Supply ties require a tenant to acquire certain products from the pub company under the terms of its lease in exchange for special lease terms. Following the report, the Committee has urged the Office of Fair Trading (OFT) to investigate whether such supply ties are anti-competitive. The question of whether beer ties have an anti-competitive effect has a long history under competition law. The OFT last reviewed the market in 2004 and found no anti-competitive practices. However, the OFT has stated that it would consider any new evidence which is brought to it and any super-complaint which a consumer body might choose to bring.
