The High Court has overturned the Hampshire Minerals and Waste Core Strategy (Core Strategy) adopted in July 2007 by Hampshire CC, Portsmouth City Council, Southampton City Council, and the New Forest National Park Authority (Minerals Authorities). It was found that the Core Strategy left the critical question of whether the existing facilities were sufficient to cope with the anticipated demand to a subsequent review of those facilities. Thus, the Core Strategy did not follow the guidance in PPS12 which required the Core Strategy, and not some subsequent document, to set out the strategy for ensuring that Hampshire’s anticipated demand for crushed rock would be met.
