The General Council of the Judiciary and the Spanish Data Protection Agency will collaborate for the inspection of judicial authorities with regard to data protection The President of the Supreme Court and of the General Council of the Judiciary (CGPJ) has signed a partnership agreement with the Director of the AEPD to carry out data protection inspections in judicial authorities. The partnership agreement establishes cooperation mechanisms between both institutions to investigate a possible violation of the data protection regulations. The CGPJ has competence over the processing of personal data for court procedure related purposes, while the AEPD has competence over the processing of personal data for non-court procedure related purposes. The CGPJ will notify the AEPD when it intends to launch an inspection of a judicial authority to investigate a possible violation of data privacy in relation to jurisdictional files. To the contrary, the AEPD will notify the CGPJ when it intends to examine a judicial authority in case of a possible violation of data privacy. In both cases, the inspectors of both bodies will carry out the inspection, without assuming any of them competences that belong to the other. The agreement signed also foresees the collaboration between both institutions in the development of Codes of Good Practice for Users of the Information Systems in the Judicial Administration. The aim of these Codes is to help judicial authorities comply with the obligations introduced by the GDPR. Finally, the document contains a provision that introduces training actions on Spanish and European data protection regulations, specially in the fields related to police and judicial matters, carried out jointly by the AEPD and the CGPJ.
