Following the recent earthquakes in Istanbul and nearby surroundings, a press release was made stating that the Ministry of Environment and Urbanization ("Ministry") plans to impose building inspection obligations on zoning forbearance applicants.

The Ministry is considering including a provision in the upcoming draft omnibus code that would require building inspections for the millions of buildings across Turkey that received building registration certificates by applying for zoning forbearance.

With the new regulation, the content of which is reflected in the press, buildings that are considered "risky" after inspection will be demolished within 60 days. The Ministry also intends to include these buildings within the scope of urban transformation and to ensure that they benefit from all of the related opportunities such as the rent allowance granted to urban transformation areas. Once the draft omnibus code is enacted, more details will be provided.
