In a Communication dated 18 January 2011, the Commission put forward proposals aimed at strengthening, amongst other things, the economic dimensions of sport. The paper also briefly addresses issues relating to the application of competition law to the sports sector. One is the question of potential financial benefits of collective selling of sports media rights for professional sports bodies. The Commission notes that such arrangements do inherently restrict competition but accepts that such arrangements may benefit from exemption under Article 101(3) TFEU where the conditions are met. In particular, where the efficiencies and benefits of the arrangements outweigh the negative aspects and are no more restrictive than necessary. The paper also mentions the issue of the application of the state aid rules to sport and noted the call from stakeholders for further clarification regarding the financing of infrastructure and sports organisations. The Communication has been sent to the Council and European Parliament for debate.
