The Federal Budget was tabled on Monday, June 6, 2011. Similar to its proposal in the last Federal Budget, the Government has proposed amendments to the Canadian Human Rights Act and the Canada Labour Code to prohibit federally regulated employers from setting a mandatory retirement age unless there is a bona fide occupational requirement. The Government also proposes to review other acts to further this objective. The budget does not indicate what the specific amendments would be. It also does not address whether the current exemptions with respect to pension and benefits plans will remain in force.
The actual Budget Bill had not been introduced and the House of Commons is in recess until September 19, 2011. We will keep you apprised of the details of the bill, once introduced.
