The Home Owner and Debtor Protection (Scotland) Act 2010 entered into force on 30 September 2010. This Act of the Scottish Parliament provides the strongest legislative protection in the UK to home owners against repossession. All cases of repossession will now come before the courts, with lenders having to provide evidence that they have treated borrowers who are in arrears fairly and that they have followed FSA rules which require repossession to be a last resort.
