The change affects the consultation period that applies where an employer proposes to make 100 or more employees redundant at one establishment within a 90 day period.  With effect from 6 April 2013, the minimum consultation period in such a case was reduced to 45 days from 90 days.

In addition, the time period for submitting an HR1 form was reduced to 45 days before the first dismissal takes effect.

There has been no change to the consultation period where an employer proposes to make 20 or more (but fewer than 100) employees redundant at one establishment within a 90 day period – the minimum consultation period remains 30 days and the HR1 form is to be lodged at least 30 days before the first dismissal takes effect.

Nor has there been any change in the upper limit for a protective award, which remains at 90 days’ pay.
