On April 6, 2009, the Student and Exchange Visitor Program (SEVP) issued Policy Guidance relating to the recent changes in post-completion Optional Practical Training (OPT) for F and M nonimmigrant students. These changes became effective on April 8, 2008, when an Interim Final Rule was published. The Policy Guidance is effective as of April 23, 2008. The Policy Guidance instructs Designated School Officials (DSOs) of SEVP-certified schools on topics such as deadlines for applying for post-completion OPT, beginning and end dates of post-completion OPT, limits on periods of unemployment during a period of OPT, the 17-month extension for F students with STEM (science, technology, engineering or math) degrees, cap gap extensions for F students who are beneficiaries of H-1B petitions, and reporting obligations. The Policy Guidance outlines methods that the SEVP staff considers acceptable, techniques that the SEVP staff uses, and data that the SEVP staff needs to review student issues. SEVP will consider a school’s use of these practices in evaluating a school’s compliance with its legal obligations.
