Walcownia Rur Jednosc Sp. z.o.o. (WRJ) and Walcownia Rur Jednosc Serwis Sp. z.o.o. (WRJ-Serwis), seamless tube producers, were both taken over by the state-owned Polish company, Towarzystwo Finansowe Silesia Sp z.o.o. (TFS). Both WRJ and WRJ-Serwis had suffered financial difficulties and, as a result of the takeovers, TFS injected capital into the companies. The European Commission (Commission) has commenced an investigation into these investments. If the public capital injections were made on terms which a private investor would have made, taking into account the market conditions, this will not amount to State aid. The Commission does not think that, in the circumstances, a private investor would have made the same investment as TFS and therefore the injection of capital would be considered to be restructuring aid and would be incompatible with the national restructuring plan for the steel industry and Protocol 8 of Poland’s Accession Treaty.
