New Law Aims to Eliminate All Forms of Undeclared Work

As of August 7, 2017, Emergency Ordinance No. 53 imposes new employer obligations, including: (1) have a written employment agreement in Romanian language, before the beginning of employment; (2) provide a copy of the employment agreement to the employee prior to commencing work; (3) maintain copies of the individual employment agreements for all employees who are providing work in a central location; (4) keep record of employees’ working hours; and (5) submit these records to labor inspectors whenever requested or required. Employers are subject to a fine of RON 10,000 for noncompliance.


Proposed Telework Law Introduced

Noting the European Framework Agreement on Telework (2002), the government has published proposed new legislation to regulate working from home in Romania. The proposed legislation includes equal treatment, voluntary choice to telework, prohibition of overtime work, and sanctioning for breach of employer’s obligations.
