The NHS has recently announced plans to update its terms and conditions for the provision of goods and services.
The relevant contracts had last been updated in 2010, and are now restructured to include both a stand-alone contract with default terms and conditions and a series of optional provisions, which can be used if necessary. This is to ensure that the key terms and conditions remain enforceable, but variations are also possible if required by a particular project.
These contracts are supported by helpful guidance notes, providing clear instructions as to how and when to use the new terms and conditions, and what might be the relevant considerations to the use of the optional provisions.
Following this publication, we now await a new framework agreement for goods and services, which will give further insight in these new terms and conditions.
