• The Seventh Circuit ruled that Allied Electrical Contractors Inc. must pay delinquent contributions to a multiemployer pension fund despite the fact that the contractor never signed a letter of consent agreeing to be bound by a clause in the collective bargaining agreement that increased the contractor’s hourly contributions. Although Allied did not sign the letter of consent, the court noted that Allied had made contributions to the fund for several months at the increased rate, and therefore manifested its assent to the increased rates through its course of conduct.
