On 2 December 2014, a speech given at the ABI Motor Conference 2014 by the UK Secretary of State for Justice highlighted steps which will be taken in the UK to deal with insurance claims fraud. According to the published speech, the UK Government intends to tackle fraudulent claims in the wider personal injury sector. Amongst other matters, it is expected that legislation will be updated to provide that claims will be dismissed entirely where any part of the claim is proven to be fraudulent. The speech alluded to key areas which will be the focus of a taskforce to be established to consider the claims fraud issues. These include whether there are any gaps in the current process (e.g. amongst stakeholders such as insurers, lawyers and intermediaries) and whether the legal framework in place could be improved. The Commissioner will seek to work collaboratively with the industry (and the legal profession) and aims to report initial findings by March 2015.
