The Court of Chancery has adopted an order to amend its rules by deleting existing Rule 5(g) and incorporating Rule 5.1 governing the filing of pleadings under seal. This Rule will revise the Court's existing Rule 5(g) pertaining to the filing of documents under seal, which was originally enacted in 1990. This new Rule provides a defintion of "good cause" that requires that only documents that contain sensitive, confidential information will qualify for sealing.
The Court has also issued a memorandum which explains the Rule's purpose and how the Rule will work. The new Rule will become effective January 1, 2013.
