As the UEFA European Championship and the FIFA World Cup can be considered major events of interest to the general public, the government of a member state can enforce their free-to-air television broadcasting, prohibiting their broadcasting on pay television and limiting the exclusive rights of television broadcasting.

Validity of the European legislation limiting the price television networks can charge for the audiovisual rights of sporting events to which they have exclusive broadcasting rights, so that the images can be included in news summaries. The disadvantages caused by this ruling are not considered disproportionate to the objectives pursued, and are satisfactory to achieve a fair balance between the different rights and fundamental liberties at stake in this case.

Interpretation of the concept "communication to the public," which involves an organization different to the original broadcaster transmitting on the internet the works included in a terrestrial television broadcast, making this available to the organization’s subscribers, who receive the broadcast by connecting to its server.
