Poland - New Draft of Electronically Supplied Services Act leaked to Press

A new draft of the Act on Electronically Supplied Services was recently leaked by one of the major Polish newspapers. The draft was prepared by the Ministry for Digitization. Key themes to note in the leaked draft include: limits proposed on the ability of ISPs to remove/block access to certain content because of its policy or terms and conditions of the service; introduction of a fast track litigation procedure enabling users, whose content has been blocked, to file a request to the court to enable access to the blocked content; and the activities of ISPs are subject to Polish law and the jurisdiction of the Polish courts. Fake news stories are also mentioned and the draft Act enables users to post a graphic symbol and description of content which is doubtful as to its accuracy and reliability. The Ministry for Digitization stated that the draft is not final and that developments will be communicated to the public.
