As of January 1, 2010, prevailing wage determinations used for H-1B, H-1B1 (Chile and Singapore), H-1C, H-2B, E-3 (Australia) petitions and permanent labor certifications (PERM) will no longer be provided from the local State Workforce Agency (SWA). The SWA will honor and process any prevailing wage requests filed prior to January 1, 2010. However, as of January 1, 2010, the Department of Labor (DOL) will issue all prevailing wage determinations using the ETA Form 9141. The ETA Form 9141 can be accessed through the iCERT portal or online at http://www.foreignlaborcert.doleta.gov/pdf/ETA_Form_9141.pdf

As of today’s date, prevailing wage requests cannot be submitted online or by fax. The DOL expected to have an online filing system available to the public as of January 20 ,2010, but there appear to be initial delays. Until the online system is available for submission of the ETA 9141, this form must be submitted in hardcopy via the U.S. Postal Service or express mail services (such as FedEx) to the following address:
