Where, on divorce or dissolution of a civil partnership, rights to a pension are shared under the provisions of the Welfare Reform and Pensions Act 1999, and those rights include a proportion of contracted-out rights, under current law the contracted-out rights are treated in a different way from other shared rights. For example, they cannot be taken before age 60. With effect from 6 April 2009, the concept of what are known as “safeguarded rights” will be abolished and shared rights that derive from contracted-out rights will be treated in the same way as other shared rights. References to safeguarded rights in other pensions regulations will be removed.
