Mylcrist Builders Ltd v Mrs G Buck [2008] EWHC 2172 (TCC)

A standard arbitration clause in a consumer contract has been held to be an unfair contract term. The clause provided that any disagreement that arose in connection with the contract was to be referred to arbitration. The court concluded that such a clause caused a significant imbalance in the parties’ rights and obligations arising under the contract, to the detriment of the consumer.
