The Mississippi Commission on Environmental Quality (“Commission”) and Joe McGee Construction Company, Inc. (“JMCC”) entered into a February 7th Agreed Order (“AO”) addressing alleged violations of Mississippi Mining Storm Water General Permit. See Order No. 6721 17.

JMCC operates a surface mining site in Brandon, Mississippi.

The AO provides that JMCC was notified of certain alleged violation of Mississippi Mining Storm Water General Permit Certificate of Coverage No. MSR322449. The alleged violations include:

  • Violation of ACT6 S-1(1):Failure to implement the site specific SWPP
  • Violation of ACT6 S-2(10):Failure to perform maintenance of erosion and sediment controls
  • Violation of ACT6 S-3:Failure to mark mine boundaries
  • Violation of ACT8 S-1:Failure to submit an annual Site Inspection Report

JMCC provided documentation at Administrative Conference that corrective actions for the alleged violations had been undertaken. Mississippi Department of Environmental Quality staff are stated to have subsequently verified that the deficient site conditions had been adequately addressed.

The AO assesses a civil penalty of $9,500.
