In order to fulfill one of the commitments made in response to the Leveson Report, the ICO has added a media data rights advice section to its website. The section contains advice for individuals on the following matters:
- subject access requests under the DPA;
- what to do if unlawful processing of personal data by a media organisation is suspected; and
- guidance for whistleblowers.
Individuals are encouraged to file a subject access request if they wish to receive a copy of information that is held about them by press and media organisations, but are reminded of the exemptions within the DPA which may allow an organisation to comply with the subject access request.
The ICO has said that it will be publishing further guidance on the section 32 exemption, which applies where an organisation is processing data with a view to publication of journalistic material.
