Court fees increased from 1 April 2013. Arguably it has never been more expensive to litigate in the Scottish courts. Court of Session fees in particular have increased in recent months. A 3 hour hearing before 3 judges in the Inner House now costs £1,308 per party. If parties are unfortunate enough to require a hearing out of hours before 3 or more judges, the cost would be £1,572 per party for a 3 hour hearing.
Even a hearing before a single judge is relatively expensive (albeit motions and single bills are excluded). Each party must pay £87 per 30 minutes (or part thereof). So a full day hearing before a single judge from 10 until 4 with an hour for lunch would cost each party £870.
These costs should certainly enourage parties to settle! A link to court fees up to 31 March 2015 is here.
