The Employment Tribunal may award compensation for injured feelings in discrimination cases and in cases of whistleblowing where the claimant alleges detriment. This is separate from any award of compensation for financial loss.

When considering the appropriate award for injury to feelings, if applicable, the Tribunal is guided by the Vento Bands as established in the case of Vento v Chief Constable of West Yorkshire Police (No 2).

Today, the Presidents of the Employment Tribunals in England, Wales and Scotland published a response to a consultation on the Vento Bands. The Vento Bands have increased, and the new Bands are as follows:

  • Lower Band: £800 to £8,400
  • Middle Band: £8,400 to £25,200
  • Upper Band: £25,200 to £42,000

Only the most exceptional cases will be capable of exceeding an award of £42,000.

The new bands will apply to claims presented on or after 11 September 2017.
