• The United District Court for the District of South Carolina held that the NLRB lacked statutory authority to promulgate its regulation requiring private employers to post a notice of employee rights under the National Labor Relations Act (“NLRA” or the “Act”). The next day the U.S. Court of Appeals for the District of Columbia Circuit enjoined the NLRB notice posting requirement pending a ruling on the appeal of the cases challenging the Board’s authority to issue the posting rule. Nat’l Ass’n of Mfrs. v. NLRB. The NLRB issued a press release stating, “[i]n view of the DC Circuit’s order, and in light of the strong interest in the uniform implementation and administration of agency rules, regional offices will not implement the rule pending the resolution of the issues before the court.”
