Following judgment in the Corner House application (see our March 2008 Update), HMCS Civil Procedure Rule Committee has published a policy paper recommending consultation on whether further categories of court documents should be made available to non-parties. The documents proposed are Appellant’s Notices, Respondent’s Notices (in appeals), Skeleton Arguments and Part 8 Acknowledgements of Service. The paper also sets out a nonexhaustive list of documents considered not to be statements of case, including witness statements, affidavits and experts’ reports, which will therefore not be released without a court application
