Timing: The U.S. Citizenship and Immigration Service ("CIS") issued a new I-9 Form on March 8, 2013. The I-9 Form is used to verify that an employee has employment authorization and is eligible to work. Employers are strongly encouraged to use the new version immediately. However, the CIS understands that it may take some employers longer to switch to the new form due to the use of electronic I-9s. The CIS has given a 60-day "grace" period for employers to make the switch. As of May 7, 2013, the new version must be used and previous versions cannot be used. Failure to use the correct version of the form can result in penalties.
What is different: The new version is designed to minimize errors. The form now contains more detailed instructions. It is now a two-page format with additional information about timing requirements for completion and how to complete the form on the form itself. Additional data fields are also designed to minimize errors.
Where can I find the new version: To download the form, please click here. Forms can also be ordered by calling 1-800-870-3676. Please check that the form states (Rev. 03/08/2013) in the bottom left-hand corner. As of today, the CIS' website still downloads the (Rev. 08/07/2009) version in the Forms and the I-9 Central sections.
What you need to do: Use the new I-9 for all new employees hired. Unless their employment authorizationi must be re-verified, current employees do not need a new I-9 to be completed if there is a properly completed I-9 on file for them. Re-verification must be done on the new I-9 form.
