A split United States Supreme Court refused to limit the Navy’s use of sonar to locate enemy submarines notwithstanding its potential harm to whales and other marine mammals. This case involved a challenge to an executive waiver allowing the sonar testing to proceed without performing an environmental impact study. This ruling removes a court imposed restriction limiting the sonar’s use to a 2,200 yard perimeter and prohibiting its use during surfacing exercises.
