On August 18, 2010, the CIT granted summary judgment in favor of Plaintiff Citizen Watch Co. of America in Citizen Watch Co. of America v. United States. The CIT found that CBP had misclassified Citizen’s watches as falling under HTSUS subheading 4202.99.90, which encompasses jewelry boxes and other items. The CIT explained that the watch boxes were intended to be for short-term use and should be classified under HTSUS subheading 4819.50.40, which would include boxes designed for the use and shipping of watches.
