While the Final Rule requiring that hospitals provide Medicare beneficiaries with advanced notice of their appeal rights prior to discharge was published last November, relevant standardized notices and Medicare program guidance were recently published that provide hospitals with details regarding how the rule should be properly implemented. CMS published the standardized “Important Message” and “Detailed Notice of Discharge,” along with guidance regarding which Hospital Issued Notices of Noncoverage will no longer be used. Hospitals must provide traditional Medicare and Medicare Advantage beneficiaries with the Important Message within two days of admission, and follow up with a Detailed Notice of Discharge no sooner than two days prior to discharge. Medicare has provided guidance regarding what to do in the event of short stays, discharges to step down care, and how to use the Important Message and Detailed Notice of Discharge operationally. A number of questions remain, and hospitals continue to object to the additional time and personnel that will be required to properly implement the new rules.
