In April 2014, the Attorney-General’s Office sought submissions from interested organisations and individuals in relation to the statutory review of the Personal Property Securities Act 2009 (Cth) (“PPS Act”).

The review will consider the operation and effects of the PPS Act, including its impact on small business and consumers.  The review will also consider technical submissions that will simplify the language of the PPS Act and achieve further efficiencies in the regime.  Submissions have recently closed, with an interim report to be provided to the Commonwealth by 31 July 2014.

Adam Colabufalo of Russell Kennedy entered a technical submission proposing modifications to the PPS Act that would assist in generating transaction efficiency by removing unnecessary exclusions when acquiring and disposing of serial numbered goods.
