The D.C. Circuit Court of Appeals has granted a motion to reopen a challenge to nuclear waste fees that the Department of Energy (DOE) established. Nat’l Ass’n of Regulatory Util. Comm’rs v. DOE, No. 11-1066 (D.C. Cir. 2/27/13). Plaintiffs contended in their motion that DOE improperly justified continuation of the fees after the court had found a prior, allegedly identical DOE fee-adequacy determination defective. The order reopening the case calls for the parties to complete briefing the issues by July 17, 2013.
