On 22 September 2011, the ECJ dismissed an appeal by Belgium against a General Court ruling which annulled the Commission’s decision to approve state aid in favour of La Poste, the Belgian public postal entity. The ECJ held that the General Court was justified in deciding that the Commission had failed to open a formal investigation into the aid which constituted a breach of the applicant’s procedural rights.
