Please be advised that today, November 25, 2014, the Supreme Court of the United States issued an order granting petitions for a writ of certiorari for review of the United States Court of Appeals for the District of Columbia Circuit’s decision upholding EPA’s mercury and air toxics standards ("MATS") for existing coal- and oil-fired electric generating units ("EGUs"). The Court is limiting review to a single question: “Whether the Environmental Protection Agency unreasonably refused to consider costs in determining whether it is appropriate to regulate hazardous air pollutants emitted by electric utilities.”
