The HSE prosecuted SDI Group UK Limited, Steel Construction Ltd and Richard Berwick of RM Berwick Steel Erection Services Ltd following an incident where an employee, Wayne Simpson, fell more than nine metres, leaving him paralysed from the waist down. Mr Simpson had been working on a construction site and was installing a racking system when he fell from height onto a concrete fl oor below. The investigation established that there was no appropriate system of work to protect employees against falls, with no fall protection measures in place. At Lincoln Crown Court, each company pleaded guilty to breaching section 3(1) HSWA 1974 with SDI Group fi ned £80k with £20k costs and Steel Construction fi ned £50k with £22k costs. Mr Berwick pleaded guilty to breaching section 37(1) HSWA 1974 and was fi ned £40k with costs of £5k. He was also disqualifi ed from acting as a director for four years.
