As a result of the President’s resolution “On measures to improve public administration in the field of the intellectual property”, The Intellectual Property Agency was transferred to the Ministry of Justice from the 8th February 2019. The President’s resolution entailed important changes to the trademark registration procedure.
The resolution outlined that from 1st March 2019, trademark applications would be filed to the Agency published on the official website within one working day, after which anyone can file an opposition against the registration. The 1st March 2019 would also mark the decrease in the trademark non-use period, from 5 years to 3 years. The resolution also noted that up until 1st July 2019, there would be an inspection of all registered trademarks so as to ensure none constituted the unfair registration of well-known trademarks. If any were identified as such, they would be cancelled.
According to the dates given by the President’s Resolution, it is to be expected that from 1st September 2019, only electronic filings will be accepted.
