EU unregistered design rights, which gives 3 years of protection to designs (including aspects such as surface decoration), derives directly from EU law and has not been implemented under English law. Brexit threatens to leave a gap in protection for British designers. The British Government has announced plans to enshrine all EU law in UK law on Brexit, however it is unclear how this will work in practice. Baker & McKenzie London is involved in roundtables with the UK IPO, which is advising the government on these issues.
