Of interest to Indian corporates with multi-site operations in the UK is a recent case brought by the union USDAW on behalf of former employees of Woolworth and of Ethel Austin. The court held that an employer with multi-site operations cannot isolate its branches/offices or shops as separate establishments for the purpose of avoiding consultation of its employees prior to their redundancy. Where an employer is proposing to dismiss as redundant 20 or more employees within a period of 90 days or less, it is under an obligation to consult its employees even if the employees in question work at different branches/offices or shops.
