Normative Resolution No. 99, effective December 21, 2012, permits adult dependents of foreign workers under local contract in Brazil who are offered localized employment in Brazil to file a work permit application before the Brazilian Ministry of Labor. This is the only category in which dependents of temporary foreign workers are permitted to work in Brazil.
The adult dependent’s filing can either be submitted simultaneous with the principal’s filing before the Ministry of Labor or once the principal’s application has been approved. The dependent will be required to provide evidence of the offer, but no educational (legalized diploma(s)) or past employment references will need to accompany the application. Once the Ministry of Labor issues its approval, which generally takes around forty-five days, the dependent will need to apply for his/her visa at a Brazilian Consulate overseas. The validity of the dependent’s work visa will coincide with the principal’s validity.
