As from 3 January 2019, a change in UK law now enables single parents through surrogacy (domestically or internationally) to apply for a parental order to become their child’s legal parent and to obtain a UK birth certificate which reflects that.

Until now the availability of a parental order was limited to two people in a relationship akin to marriage. A parental order is an order which the court may make conferring legal parentage and parental responsibility on a person.

Single parents now have until 2 July 2019 to apply for a parental order retrospectively. Applications beyond that point are likely to be possible but the process may be more complicated.
