U.S. Representative Bill Pascrell of New Jersey has introduced a new bill, H.R. 4540, the “Accountability in Deferred Prosecution Act of 2014” in the House of Representatives, that would require the U.S. Attorney General to issue public written guidelines relating to the use and substance of deferred prosecution agreements and non-prosecution agreements. The bill comes as part of an ongoing debate about use of these agreements by the DOJ and SEC to allow defendants, which are frequently corporations, to settle investigations without admissions of guilt.
