Lifeways Community Care Ltd were prosecuted following the death of an 18 year old disabled resident who was lowered into an excessively hot bath causing her to sustain fatal scalding injuries. The carers attempted to limit the patient’s injuries by immediately placing her under a cold shower. Despite her subsequent transfer to a specialist burns unit, the patient died four days later. The HSE investigation established that whilst a valve had been fi tted to the bath to prevent scalding, it had not been correctly set and the training received by carers in relation to the risk of scalding was also lacking. Lifeways Community Care Ltd pleaded guilty to a breach of section 3(1) of the HSWA and was fi ned £100k plus £45k costs.
