The Ministry of Justice (MoJ) has confirmed, as we had been previously informed, that a second Discount Rate consultation will be published in the autumn.

This will seek views on whether the restrictions on the factors that can be taken into account in prescribing a rate under section 1 of the Damages Act 1996, are still appropriate.

With a second consultation in the autumn and a change in leadership at the MoJ, the exercise of the Lord Chancellor's power, pursuant to the Damages Act 1996, to make any change in the Discount Rate may not take place this year.
