The USCIS announced that the H-2B quota for fiscal year 2009 (October 1, 2008 through September 30, 2009) was met on January 7, 2009. This year’s H-2B quota was again limited to 66,000 with one half of the quota reserved for the first half of the fiscal year and the second half of the quota reserved for the second half of the fiscal year. This year’s H-2B quota was met approximately one week later than the quota was met during the last fiscal year. The USCIS will now reject any H-2B petitions subject to the H-2B quota requesting a start date prior to October 1, 2009. However, the USCIS will continue to process petitions filed to extend the stay of a current H-2B worker in the United States, change the terms of employment for current H-2B workers and extend their stay, or allow current H-2B workers to change or add employers and extend their stay.
